Access to either website is subject to the following terms and conditions in addition to the Memory Boxes.co.uk standard terms and conditions of sale and service.

When You [where "You" means the person using this site] access either site for the first time you agree to be bound by all terms and conditions for the use of this Service [where "Service" means the online service provided by Memory Boxes.co.uk from time to time]. These terms cover all users of either website. Memory Boxes.co.uk agree to provide you with the service in accordance with these terms and conditions. We may vary the terms and conditions relating to the use of this service. Any changes will be posted on this page for you to view. It is your responsibility to check the published terms and conditions from time to time for any changes that may affect your use of this site.

We will take all reasonable care to ensure that product details, descriptions and prices that appear on the website are correct and up to date. However, we accept no responsibility for keeping the information on these pages up to date or liability for any failure to do so. The information and material contained on this site is for information only and whilst we try to ensure the highest standard of quality in the archival products supplied it is the responsibility of the user to ensure that the goods purchased are suitable for the intended purpose. All products and prices are subject to stock availability and we reserve the right to amend our range of products at any time without notice.

The service will be provided on an "as is" and "as available" basis. We cannot guarantee that the service will be provided fault-free and free from defects. We reserve the right to modify, change or withdraw this website (or part thereof) with or without notice. The following electronic steps are followed in the creation of a sales contract between you and us:

You select products on the website and place them in your electronic shopping basket. You will be guided through the process of placing an order by a series of simple instructions on the website.

You place your order when pressing the confirm button at the end of the checkout process. We will send you an order acknowledgement email detailing the products you have ordered.

When your product is shipped from our warehouse we will send you a despatch confirmation again by email.

Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the product(s) ordered unless we have notified you that we not accept your order or you have cancelled it.

Non-acceptance of an order may be the result of one of the following:
1) Product unavailability
2) Identification of a pricing or product description error
3) You not meeting the eligibility to order criteria laid down in our Terms and Conditions.

The contract will be concluded in English.

Where goods are offered subject to 'discount', 'money off', 'multibuy', clearance' or 'special offer', the discount or offer entitles you to a saving of the amount & currency/percentage stated in the promotion, for the number or value of qualifying products, and for the dates specified. Unless stated otherwise, the discount is available on purchases of full price and promotional items only (offer excludes permanently reduced/sale items and concession items), when you spend (at least) the minimum amount required on qualifying items and in a single transaction. The discount cannot be used in conjunction with any press, magazine, discount or any other promotion.

For products under offer, higher prices have been applied for 28 days online. Discount applies at checkout. The discount cannot be used to purchase Memory Boxes.co.uk Gift Vouchers. No cash or any other alternative will be given. An offer may be amended or withdrawn at any time at the discretion of Memory Boxes.co.uk.

Free Gifts
Where the offer includes a 'free gift', a full or partial refund can be obtained by returning the qualifying items, together with the free item and your invoice. We cannot process refunds without these.

Sale and Clearance
'Clearance' or 'sale' prices are on selected items while stocks last. See individual product pages for details. Please note: SALE items have limited availability and are very popular. We cannot guarantee availability of SALE items until payment is taken (when we get your order ready for delivery).

Sold as Seen or Seconds
Items marked as 'seconds', 'sold as seen', 'damaged' or 'imperfect' are offered as substandard and the price will reflect this. Wherever possible we will provide a description of any flaw in the product details. Please note that we will not refund delivery charges on any item sold to you as substandard that you choose to return to us, we will only refund the cost of the product. Please see our standard terms and conditions. Your statutory rights as a consumer are not affected.

When you order from Memory Boxes.co.uk or send emails to us you are communicating with us electronically. We will send you an email confirming receipt of your order and containing the details of your order. When we are ready to despatch your order, we will send another email to confirm our acceptance of your order and to advise that your order has been despatched. If we are unable to provide any item directly from stock we will inform you again by email giving an estimated delivery time for that item.

It is therefore important that when you complete your details at the checkout that you give us a current and correct email address for all communication.

We communicate with you by email or by posting policies and information on the website. By placing an order on this site you consent to receive communications from us electronically and you agree that all such communications, notices and agreements satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

We would recommend that you add our email address sales@memoryboxes.co.uk to your 'safe sender' list to prevent any order emails being spammed. You may also want to add the domain names 'memoryboxes' and 'memories-online' to the list as well.

Each Gift Voucher is printed with a unique Voucher Code. You can submit your Gift Voucher as part or full payment with your mail order form or when ordering online please type the Gift Voucher Code into the correct field at the checkout. The total value of the Gift Voucher will be applied against the total order amount. If your order exceeds the amount of your Gift Voucher, you must pay for the balance with a credit card. The value of the Gift Voucher will be applied to your order total when the order is processed and will be reflected in the final invoice as a cash payment.

Gift Vouchers and unused portions of Gift Vouchers expire two years from the date of issuance. It is important therefore that you keep the Gift Voucher Code private as it may be used by any customer presenting the Code at checkout. Once applied to an order the Code cannot be re-used.

Gift Vouchers cannot be used to purchase other Gift Vouchers. Promotional Codes and other Discounts offered from time to time cannot be used to purchase Gift Vouchers. Gift Vouchers are subject to our standard terms and conditions of sale. Memory Boxes is not responsible for lost or stolen Gift Vouchers. Memory Boxes.co.uk will have the right to request alternative forms of payment if a fraudulently obtained Gift Voucher is redeemed or used to make purchases through the Memory Boxes.co.uk web store. The risk of loss and title for Gift Vouchers pass to the purchaser upon our delivery to the carrier (eg. Royal Mail).

Memory Boxes.co.uk reserve the right to amend these rules and regulations from time to time at its discretion and without notification.

This site contains links to other sites. Memory Boxes.co.uk is not responsible for the privacy practices or the content of such websites. In some cases, we work with other companies to provide products and services. In such cases we will never share your details directly with another company.

Independent bodies or individuals may from time to time contribute information guides to this site. As such the view, opinions and beliefs expressed in these guides are not intended in any way to reflect those of Memory Boxes.co.uk and the web publishers.

Memory Boxes.co.uk shall not be liable to the Customer for the loss of profits or contracts or other indirect or consequential loss whether arising from negligence, breach of contract or howsoever.

You are not allowed to transfer or attempt to transfer this agreement in whole or in part to any other Person [where "Person" means an individual, body corporate or incorporated].

Memory Boxes.co.uk will not be liable for any failure of service or delay in performance caused by circumstances beyond our reasonable control (including without limitation breakdown of plant or machinery, strike or industrial dispute, shortage of materials or failure of or delay in receiving supplies, act of war (whether declared or not), Act God, or any law regulation of any government or any local or municipal authority).
